Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Kharik P.S. Case No. 153 of 2022 registered for the offence punishable under Sections 147, 148, 149, 341, 342, 323, 307, 436, 186, 188, 332, 333, 338, 353, 427, 504 of the Indian Penal Code. As per the prosecution case, the allegation against the petitioner is that he was the member of mob of 100-150 persons who damaged the police vehicle, railway line and also attacked on police team during protest of recruitment through Agnipath Yojna in Army.

Learned counsel for the petitioner submits that petitioner

Patna High Court CR. MISC. No.49746 of 2022(2) dt.14-12-2022 2/2 is a student who has been falsely implicated in this and is in custody since 19.07.2022. He has no criminal antecedent and the charge-sheet has already been filed.

Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- 1st, Naugachia, Bhagalpur in connection with Kharik P.S.
