JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2016 Petitioner being mother of the husband of the victim is apprehending her arrest in a case registered for the offences punishable under Section 304B/34 of the Indian Penal Code.

The basic accusation is of killing the daughter of the informant within one year of marriage by causing burn injury for non-fulfilment of dowry demand. It is submitted by learned counsel for the petitioner that informant subsequently got her age recorded under Section 164 Cr.P.C where he stated that the victim received accidental burn injury while cooking and she was being given medical assistance by the petitioner's family and the in-laws have no role in the whole incidence. Case No. 276 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
