JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2016 Petitioner being mother of the husband of the victim is apprehending her arrest in a case registered for the offences punishable under Section 304B/34 of the Indian Penal Code.
The basic accusation is of killing the daughter of the informant within one year of marriage by causing burn injury for non-fulfilment of dowry demand. It is submitted by learned counsel for the petitioner that informant subsequently got her age recorded under Section 164 Cr.P.C where he stated that the victim received accidental burn injury while cooking and she was being given medical assistance by the petitioner's family and the in-laws have no role in the whole incidence. Considering the thrust of accusation against the husband of the victim and the retracted version of the
Patna High Court Cr.Misc. No.2785 of 2016 (2) dt.22-01-2016 2/2 informant, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Vth, Begusarai in connection with Sahebpur Kamal P.S. Case No. 276 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
