JUSTICE ARUN KUMAR ORAL ORDER 04-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 24.10.2017, seeks bail in Bhagwanpur PS Case No. 187 of 2017 registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.

The allegation in brief is that some criminals had assembled at the house of the petitioner, police reached there and one Birju Mahto was apprehended along with the petitioner, from the possession of Birju Mahto loaded country made pistol, two live cartridges and mobile was recovered and from the possession of the petitioner three live cartridges, mobile and one motorcycle were recovered.

Learned Counsel for the petitioner submits that the petitioner has been falsely implicated, only three live cartridges are said to have been recovered but no fire arm, the petitioner is in custody since 24.10.2017 and he has only one criminal antecedent prior to this case under Section 307 IPC.

Having considered the said facts and circumstances, the petitioner, namely, Neeraj Kumar Mahto is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two
