Petitioners are apprehending their arrest in connection with Kahalgoan P.S.Case no.764/2018 , registered for offences punishable under Sections 323, 307, 506/34 of the Indian Penal Code.

Allegation against the petitioners is that they assaulted the father of the informant and when he and his sister went to save him, they were also assaulted by rod.

Submission of the learned counsel for the petitioners is that the injuries are simple in nature , which will appear from the impugned order as such no case is made out under Section 307 of the Indian Penal Code.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Bhagalpur in connection with Kahalgoan P.S.Case no.764/2018 dated 24.12.2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
