2. The petitioner apprehends her arrest in connection with Warisnagar P.S. Case No. 300 of 2021 for the offence punishable under Sections-120(B), 302, 34 of the Indian Penal Code and 27 of the Arms Act.

3. Earlier prayer for anticipatory bail of the petitioner was rejected by order dated 10-01-2023 passed in Cr. Misc. No. 39994 of 2022 but fresh ground for renewal of prayer for bail is that in Sessions Trial No. 446 of 2022, the informant alongwith his son and daughter has been examined as P.Ws. 1, 3 & 4 respectively and all of them have stated that they could not identify the person, who fired at the deceased.

3. Learned counsel for the petitioner has submitted that the co-accused (X) faced trial in J.J. Board in which, all the witnesses became hostile and the co-accused (X) was acquitted by the Juvenile Justice Board.

4. Learned Spl. APP has opposed the prayer for bail.

5. Considering the above-mentioned facts and circumstances as well as clean antecedent of the petitioner, let the petitioner named above in the event of arrest or surrender within a period of four weeks in the court below be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Warisnagar P.S. Case No. 300 of 2021 subject to the conditions as laid down under Section-438(2) of the Cr.P.C. with further condition that the petitioner will appear before the court below on each and every date fixed by the trial court and if, she makes herself absent on two consecutive dates, the learned court below shall be at liberty to cancel the bail bonds of the petitioner.
