2. The petitioner is apprehending arrest in connection with Sheikhpura P.S. Case No. 192 of 2023 dated 01.04.2023, lodged under Sections 302, 34 of the Indian Penal Code read with section 27 of the Arms Act pending before the learned C.J.M., Sheikhpura.

3. As per the prosecution story, FIR has been lodged against 13 named accused persons including the present petitioner. The allegation against the petitioner is that he has fired by pistol on the left chest of the deceased (informant's brother).

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel

Patna High Court CR. MISC. No.53715 of 2024(2) dt.31-07-2024 2/2 also submits that the petitioner is falsely been implicated in the present case. Counsel further submits that the criminal antecedent of the petitioner is clean.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. Learned counsel for the informant vehemently opposes the prayer for bail of the petitioner and submits that there is direct allegation of firing upon the informant's brother (deceased) against the present petitioner.

7. In the present facts and circumstances, this Court is not inclined to grant bail to the petitioner.

8. Accordingly, the prayer for anticipatory bail of the petitioner is hereby rejected and the petitioner is directed to surrender before the learned Trial Court within a period of 4 weeks from today.
