Petitioner seeks regular bail in a case registered for the offences punishable under Sections 406/420 of the Indian Penal Code and Section 66 of the I.T. Act.
The FIR of the occurrence of commission of cheating by change of ATM card is against unknown. The petitioner was apprehended in connection with some other case and he confessed before the police regarding his complicity in the present case.
Submission is that only confession before the police is the material against the petitioner. Petitioner has got criminal antecedent, vide paragraph 3 of the bail petition. Petitioner is in
Patna High Court Cr.Misc. No.6351 of 2018(5) dt.16-03-2018 2/2 custody since 20.11.2017.
Considering the entire facts and circumstances of the aforesaid case, let the petitioner, above named, is directed to be released on bail after completion of six months of the custody and on furnishing bail bond of Rs. 20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Madhubani(Town) P.S. Case No. 298 of 2016, G.R. No. 1588 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
