2. The hard copy of counter affidavit filed on behalf of respondents no. 2 to 5 is directed to be kept on record.

3. The Treasury Officer, Madhubani is directed to depute a competent officer under his jurisdiction to verify as to whether petitioner is alive or dead as on the date of filing of the present writ petition, the petitioner was aged about 67 years.

4. Learned counsel for the petitioner submits that the authority is pending from 2021, which was duly sent by the

Patna High Court CWJC No.12973 of 2022 dt.22-09-2023 2/3 Accountant General Office after fixing the pension of the petitioner, however, an objection has been raised that petitioner had taken an advance of Rs. 25,00,000/- and because of noncooperation of the Block Development Officer, Babu Barhi, Madhubani, the Treasury Officer, Madhubani is helpless to send the advice for crediting the amount into the bank account of the petitioner. Learned counsel further submits that he will advise the petitioner to appear before the concerned authorities along with the relevant document so as to facilitate the payment. He further submits that petitioner is suffering from several illness and he is unable to move as such some cooperation may be extended by the authorities, who are expected to redress the grievance of the petitioner.

Considering the status of the petitioner as well as admitted fact that the authority was issued long back in the year 2021 and certain paraphernalia are required to be done by the petitioner, which was required by the Treasury Officer, but due to non-cooperation of the Block Development Officer, Babu Barhi, Madhubani the same has been kept pending. The Block Development Officer, Babu Barhi, Madhubani must not further delay for any reason and take steps forthwith to cooperate the petitioner, if required. He is directed to produce all the relevant

Patna High Court CWJC No.12973 of 2022 dt.22-09-2023 3/3 documents, which are required on his part, for facilitating the payment to the petitioner in accordance with law.

6. In case the Block Development Officer, Babu Barhi, Madhubani delays the matter, for any interest, which is unethical, the District Magistrate, Madhubani is directed to take proper legal action against him and ensuring to make payment to the petitioner within a period of four weeks from the date of production of this order.

7. With the above observations and directions, the present writ petition stands disposed of.
