JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-08-2019 This application has been filed by the petitioner for grant of anticipatory bail in connection with Pipra P.S. Case No. 69 of 2018, for the offences under Sections 147, 148, 447, 341, 323, 325, 307 and 337 of IPC.
Prosecution case is that petitioner and other accused persons came variously armed and on the abatement of accused, he assaulted the informant by rod on his head, causing injury and thereafter, other accused persons have also assaulted, causing injuries.
Submission of learned counsel for the petitioner is that there is a land dispute between the parties and for that he has falsely been implicated in this case.
Heard learned APP also, who opposed the prayer for anticipatory bail by stating that the process under Section 82
Patna High Court CR. MISC. No.46955 of 2019(3) dt.28-08-2019 2/2 Cr.P.C. has already been exhausted.
Having heard both sides, in view of the facts and circumstances, as stated above, this application is disposed of with a direction to the petitioner to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below on the basis of materials available on the record as well as the nature of injury found on the person of injured, and if, possible to be disposed of on the same day.
