Petitioners apprehend their arrest in connection with Complaint Case No. 238C of 2013 registered under Sections-420, 467, 468, 471 of the Indian Penal Code.
It is contended on behalf of the petitioners that petitioner No. 1 is identifier on the sale deed in question whereas; petitioner No. 2 is one of the executants of the said sale deed. Moreover, it is admitted in the complaint petition itself that the land, in question, had been settled by the SDM, Birpur with father-in-law of the complainant as well as the petitioner. So, even if, it assumed that the petitioner No. 1 and some other accused executed sale deed
Patna High Court Cr.Misc. No.32135 of 2014 (2) dt.03-02-2015 2/2 violating the law and terms and conditions of settlement, then also, it is a case of civil nature.
Taking into consideration the above-said facts and circumstances as well as submission of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest or surrender in the court below within four weeks from today, the petitioners named-above, are directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Complaint Case No. 238C of 2013 to the satisfaction of Sri T.
