The petitioner seeks bail in connection with Shanbhuganj P.S. Case No.3 of 2015 registered under Sections 341, 323, 307, 302, 447 and 504/34 of the Indian Penal Code besides Section 27 of the Arms Act, pending in the court of the Chief Judicial Magistrate, Banka.
The accusation is that there was hot exchange of words in between Gudia Devi, wife of Amarjeet Mandal, wife of Pappu Mandal and wife of this petitioner and the informant and they also assaulted the informant. Later on, the husband of the informant pacified the matter but, thereafter, in the evening, the petitioner
Patna High Court Cr.Misc. No.48347 of 2015 (2) dt.09-11-2015 2/2 armed with lathi rushed to the house of the informant and called the husband of the informant using abusive language and when the husband of the informant came outside the house and made protest, this petitioner shot fire at the husband of the informant through his pistol causing head injury to the husband of the informant, who in course of treatment, later on, died on the next day.
Having regard to the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, the prayer of the petitioner for grant of bail stands rejected. (Rajendra Kumar Mishra, J) P.S./- U T
