The petitioner seeks regular bail in connection with Maniyari P.S. Case No. 140 of 2021 for the offence registered under Sections 363, 366(A)/34 of the Indian Penal Code. The allegation is regarding the accused persons including the petitioner having kidnapped the victim girl. The learned counsel for the petitioner has submitted that the petitioner is innocent, has been falsely implicated in the present case, is having a clean antecedent and he is languishing in custody since 16.06.2021. The learned counsel for the petitioner has further referred to the impugned order dated 14.09.2021 to show that the victim girl in her statement made under Section 164 Cr.P.C. has stated that her parents used to

No.59479 of 2021(2) dt.29-03-2022 2/3 beat her and wanted to marry her with some other person, hence she had left her house voluntarily and stayed in a temple for 10 days whereafter she had stayed in a rented house. It is also submitted by referring to last page of the impugned order dated 14.09.2021 that the victim girl is stated to have married one Guddu Kumar Sahani and she is living with him as husband and wife peacefully. Thus, it is submitted that the petitioner is having no complicity in the matter and merely on bald allegation, he has been made accused in the present case. Per contra, the learned counsel for the State has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the materials available on record as also considering the fact that the petitioner is not alleged to have either engaged in any sort of untoward behaviour towards the victim girl nor he is the person stated to have married the victim girl or enticed her inasmuch as the victim girl is stated to have married one Guddu Kumar Sahani apart from the fact that he is having a clean antecedent and is languishing in custody since nine months, I deem it fit and proper to direct for release of the petitioner herein on regular

Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Muzaffarpur in connection with Maniyari P.S. Case No. 140 of 2021.
