JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-11-2015 These two applications for grant of regular bail filed on behalf of the petitioners who are accused in connection with Sessions Trial No. 1000 of 2015/332 of 2015 arising out of Derni PS Case No. 06 of 2015 registered for the alleged offences punishable under Section 302/34 of the Indian Penal Code. Learned counsels for the petitioners submit that they were not named in the First Information Report and they have been implicated merely on the basis of confessional statement of co-accused Lal Bihari Singh. They have brought to my notice an
Patna High Court Cr.Misc. No.47573 of 2015 (2) dt.03-11-2015 2/2 order of this Court dated 12.8.2015 passed in Cr. Misc. No. 31460 of 2015, whereby the said Lal Bihari Singh has been granted regular bail by this Court, on the basis of whose confessional statement these petitioners have been made accused. In view of the fact that the said co-accused Lal Bihari Singh has been granted bail by this Court, these applications are allowed.
Let the petitioners above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned concerned courts below in connection with Derni PS Case No. 06 of 2015.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
