JUSTICE SATYAVRAT VERMA ORAL ORDER 12-07-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State along with the learned counsel for the informant. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 498(A), 120(B) of the Indian Penal Code.

The petitioner in compliance of the order dated 28.06.2023 is present in person in the Court. Learned counsel for the informant submits that despite his best endeavors, he could not communicate with the informant, as such, it appears that she is not interested in pursuing the case. Learned counsel for the petitioner next submits that from bare perusal of the allegations as alleged in the complaint, it would manifest that the allegation of demand and torture is general and omnibus in nature.

Patna High Court CR. MISC. No.49850 of 2022(4) dt.12-07-2023 2/2 The petitioner who is present in person submits that he is a laborer and works on daily wages but is willing to pay a monthly maintenance of Rs. 2,000/- to the informant.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Rohtas Complaint Case P.S. Case No. 385 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. However, it is made clear that informant would be at liberty to file an application seeking cancellation of the anticipatory bail granted to the petitioner in the event if he does not pay the monthly maintenance.
