2. The petitioner seeks bail in connection with Kurtha P.S. Case No. 139 of 2023 dated 09.05.2023, instituted for the offence punishable under Sections 304(B), 120(B)/34 of the Indian Penal Code.

3. As per the prosecution case, the informant solemnized marriage of his daughter namely, Khushnashiba Khatun with the petitioner in the year 2018. After marriage, the petitioner along with other accused persons started demanding a sum of Rs. 10,00,000/- as dowry and due to non-fulfillment of the same, the daughter of the informant has been strangulated to death on 07.05.2023.

4. Learned counsel for the petitioner submits that the

It is further submitted that due to anger and frustration, the deceased committed suicide. It is next submitted that the occurrence took place on 07.05.2023 and the family members of the informant was informed about the incident on the same day. Inquest report was also prepared on 07.05.2023 but the FIR was not lodged by the informant due to non availability of his son. When the son of the informant came on 09.05.2023, then the present case was lodged with false and concocted allegations. Learned counsel further submitted that witnesses were examined during investigation who supported the case of suicide by the deceased.

No external injury was found on the body of deceased in the post-mortem report other than a litigature mark on neck running from back anteriorly to occipital of width 2.0 cm oval in shape, tongue protuted, saliva dribling from angle of the left side of mouth, which supports the case of suicide. Petitioner has no role in the said incident. There is no evidence to suggest that the petitioner committed any offence against the deceased. Lastly, it has been submitted that the petitioner is in custody since 26.06.2024 having no criminal antecedents and charge-sheet has been submitted in the case.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Arwal in Kurtha P.S. Case No. 139 of 2023.
