JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-03-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Excise Case No. 361 of 2017, registered under Sections 30(a)(d) and 38(i) of the Bihar Excise Act, 2016.

The accusation is of recovery of 10 litres country made liquor concealed in the soil and 12 earthen pots each containing 20 litres near the pond, from where, petitioner was apprehended.

Learned counsel for the petitioner submits that while the petitioner was present near the pond for agricultural purpose, but he was apprehended mere on suspicion. It is further submitted

Patna High Court Cr.Misc. No.16775 of 2018 (2) dt.29-03-2018 that petitioner has no criminal antecedent and is in custody since 25.12.2017.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-III-Cum-Special Judge, Excise Act, Samastipur, in connection with Excise Case No. 361 of 2017. Out of two sureties, one surety must be the close relative of the petitioner.
