JUSTICE BIRENDRA KUMAR ORAL ORDER 25-08-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offences punishable under Sections 302, 201/34 of the I.P.C. and Section 27 of the Arms Act.

There is no eye witness of the actual occurrence of murder of the father of the informant though informant was there soon before fleeing away from the place of occurrence and he claims to have identified the petitioner and some unknown persons armed with pistol etc. The doctor has found single firearm injury on the person of the deceased. Trial is going on and the petitioner is ready to cooperate with the trial. Petitioner is in custody since 29.09.2020 having no criminal antecedent. Learned counsel for the informant opposed the prayer

Patna High Court CR. MISC. No.12629 of 2021(3) dt.25-08-2021 2/2 for bail.

Considering lack of direct material against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Laxmipur P.S. Case No. 369 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
