Recovery of the stolen motorcycle is said to have been made from Kabari shop of Fakhruddin who at the time of recovery disclosed that it were Badal Sahani, Deepak Sah and Robin Kumar who handed over the aforesaid motorcycle to him for sale. So far as the petitioner is concerned, it is alleged that he was also found in the aforesaid shop but stand of the petitioner is that he is mistri in the garage of the aforesaid Fakhruddin.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari in Motihari Town P.S.
