Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 448, 341, 323, 324, 354, 379, 504, 506/34 of the Indian Penal Code.

The prosecution case is that the petitioners were playing card at the door of the informant, which was protested by the informant, then petitioner no. 1, Rajeev Paswan abused by filthy language and also assaulted him with other accused persons. Petitioner no. 2 inflicted iron rod on the head of the informant. Co-accused Bajrangi Paswan pressed the neck of the informant. On alarm being raised, wife and sister- in- law of the informant came to rescue, then petitioner no. 1 Rajeev

Patna High Court Cr.Misc. No.1682 of 2016 (2) dt.13-01-2016 Paswan pulled the sari of the sister-in-law of the informant and dragged her and made assault.

It is submitted by the learned counsel for the petitioners that for a petty dispute maliciously the accusation has been levelled. The injury report is not on the record. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Considering the nature of accusation, it is a case for consideration of prayer for regular bail, let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Dumra P.S. Case No. 311 of 2015, pending in the court of learned Chief Judicial Magistrate, Sitamarhi.

With the above observation this application is disposed of.
