The petitioner seeks bail in connection with Saharsa Sadar P.S. Case No.1295/2017 (Special Case No.589 of 2017) registered under Sections 37(b), 30(a), 38(1) and 41(1) of Bihar Prohibition and Excise Act, 2016.

8 liters of country made liquor is said to have been recovered from the courtyard of the house of petitioner and the petitioner was apprehended.

It is submitted by learned counsel for the petitioner that No incriminating article has been recovered from the conscious physical possession of the petitioner. The house from where liquor is said to have been recovered is inhibited by several members of

Patna High Court Cr.Misc. No.7957 of 2018 (2) dt.13-02-2018 2/2 the family of the petitioner. The petitioner has been falsely implicated in this case. The petitioner has got no criminal antecedent. The petitioner is a lady and has been languishing in custody since 09.12.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Saharsa, in connection with Special (Excise) Case No.589 of 2017, corresponding to Saharsa Sadar P.S. Case No.1295/2017.
