So far remaining petitioners are concerned, they are apprehending their arrest in connection with Sabour (Goradih) P.S. Case No. 38 of 2019, disclosing offences under Sections 147, 148, 149, 341, 323, 302, 504 of the Indian Penal Code. Prosecution case is that petitioner and others came variously armed and stopped the sowing the seeds and on protet they assaulted the informant, his son and his wife and, there is specific allegation that his wife was assaulted by co accused, Gulabi Mandal, Raja Ram Mandal, Pankaj Kumar Mandal, Tilak Kumar Mandal and

Patna High Court CR. MISC. No.46357 of 2019(4) dt.30-09-2019 2/2 Ashish Kumar Mandal as well as by the wives of Pankaj Kumar Mandal, Raja Ram Mandal, Tilak Mandal and Pawan Mandal and due to the assault wife of the informant died. Submission of learned counsel for the petitioners is so far petitioner nos. 1, 4 and 6 are concerned, no specific allegation has been attributed to them of assaulting the deceased and so far petitioner nos. 3 and 5 are concerned and they have falsely been implicated in this case.

Learned counsel for the State and informant opposed the prayer for bail.

Having heard both sides, considering the facts , this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Sabour (Goradih) P.S. Case No. 38 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
