JUSTICE SUDHIR SINGH ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 05-05-2017 On account of the petitioner having obtained employment by producing forged documents, the disciplinary action was taken. Based on a finding of guilt recorded in the departmental enquiry, he was dismissed from the service.
Finding no error in the order of dismissal, the writ petition has also been dismissed and after hearing Sri Rajendra Prasad Singh, learned senior counsel representing the petitioner, we find no error in the order passed by the learned Writ Court warranting
Patna High Court LPA No.1385 of 2014 dt.05-05-2017 2/2 reconsideration. However, prayer was made by learned senior counsel to say that Contributory Provident Fund on deductions made by the petitioner and interest have not been paid to the petitioner. In view of the above, the petitioner shall have liberty to raise the claim of C.P.F. deductions before the competent authority and the competent authority is directed to settle the claim with regard to C.P.F. within 30 days of the presentation. With the aforesaid indulgence in the matter, the appeal stands disposed of.
