JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-01-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under sections 147, 148, 149, 341, 323, 307, 504 of the Indian Penal Code, under section 27 of the Arms Act and under section 3(1) (x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. It is alleged that when the informant was returning from his filed 17 accused persons, including the petitioners, came and Mansok Mandal fired on the informant. Petitioner No.2, Kishor Mandal assaulted with the butt of pistol on the head of Manoj Paswan. Other accused persons also resorted to fire on the informant. It is submitted by the learned counsel for the petitioners
Patna High Court Cr.Misc. No.2565 of 2016 (2) dt.18-01-2016 2/2 that injuries have been found to be simple in nature. There is counter version of the offence. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with Jagdishpur (Goradih) P.S. case No. 158 of 2015 pending in the court of learned CJM, Bhagalpur. This application is disposed of with the aforesaid observation/direction.
