2. In the present case, the petitioner seeks bail in connection with STR No. 363 of 2017, arising out of Pandarak P.S. Case No. 135 of 2013 dated 02.10.2023, registered for the offences punishable under Sections 376, 511 and 34 of the Indian Penal Code.
3. This is a case of misuse of privilege of bail. The petitioner was granted bail vide order dated 13.04.2014 passed in Cr. Misc. No. 4217 of 2014. However, due to non-appearance of the petitioner, his bail bond was cancelled and NBW was issued on 04.02.2020 and subsequently, process under Section 82 of the Cr.P.C. was issued on 30.01.2024.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.48453 of 2026(2) dt.22-07-2026 2/3 petitioner submits that petitioner did not deliberately avoid appearing before the Court. He is labourer and went to Guwahati in the State of Assam for earning his livelihood and due to transfer of the case from different Courts, he could not keep track of the case and failed to appear before the learned trial Court. Learned counsel further submits that the petitioner undertakes that he would remain present before the Court on each and every date and would not delay the trial in any manner. Learned counsel next submits that petitioner is having clean antecedent and chargesheet has been submitted. Learned counsel lastly submits that petitioner is in custody since 02.04.2026.
5. Learned A.P.P. appearing on behalf of the State opposes the submissions made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties, the petitioner, abovenamed, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Exclusive Judge (Rape & POCSO Act), Patna / concerned Court, in connection with STR No. 363 of 2017, arising out of Pandarak P.S. Case No. 135 of 2013, subject to the condition
Patna High Court CR. MISC. No.48453 of 2026(2) dt.22-07-2026 3/3 laid down under Section 480(3) of the B.N.S.S. and other following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner is directed to remain physically present before the learned trial Court on each and every date. (iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the Court concerned.
