JUSTICE ANIL KUMAR SINHA ORAL ORDER 16-11-2022 Mr. Abhishek Kumar, learned counsel for the petitioner submits that he is not pressing the impugned orders dated 14.07.2022 & 20.05.2022 passed in Title Suit No. 269 of 2018. He next submits that though the suit has been filed in the year 2018 and all plaintiff's witnesses have been examined and the suit is fixed for examination of witnesses on behalf of the defendants for which direction was issued by the trial court to the defendants to
Patna High Court C.Misc. No.592 of 2022(2) dt.16-11-2022 2/2 bring their evidence but the defendants are not producing evidence in order to delay disposal of the Title Suit. Accordingly, submission is that necessary direction be issued to the trial court to dispose the Title Suit in accordance with law on its own merit within a reasonable time frame. Taking into consideration the fact that plaintiff's witnesses have already been examined and defendants' witnesses are to be examined, I direct the learned trial court i.e. Sub Judge-V, Bhabua, Kaimur to dispose the Title Suit No. 269 of 2018 expeditiously as early as possible preferably within one year from the date of receipt / production of a copy of this order. It is made clear that no unnecessary adjournment shall be granted to either of the parties.
