The petitioners are languishing in jail since 29.05.2015 in a case instituted under Section 392 of the Indian Penal Code. It is alleged by the informant that on 19.04.2015 a truck was loaded with Kirana goods and reached at Banelee Canal and at that time one white colour Scorpio vehicle stopped the truck and accused persons looted the goods.
It has been submitted on behalf of the petitioners that petitioners have got no criminal antecedent. They are in custody since 29.05.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the
Patna High Court Cr.Misc. No.36502 of 2015 (3) dt.05-10-2015 petitioners. Petitioners are not named in the FIR. They have not been put on test identification parade nor there is recovery of any incriminating article.
On behalf of the State, it has been submitted that the petitioners' name have come in course of investigation. Considering the aforesaid facts, let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Supaul in connection with Jadiya P.S.Case No.44 of 2015.
