JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 16-12-2022 The learned counsel for the petitioners is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioners as well as learned APP for the State.

In this case, the petitioners are seeking regular bail in connection with Jamui P.S. Case No. 448 of 2021, registered for the offences punishable under Sections 304 (B), 328/34 of the Indian Penal Code.

As per allegation, the sister of the informant was married to co-accused Ganesh Ravidas in the year 2020. The husband and in-laws inflicted atrocities upon the sister of the informant as their demand of a golden chain and Rs. 2 lac cash was not fulfilled. On 16.10.2021, the informant received an

Patna High Court CR. MISC. No.49560 of 2022(2) dt.16-12-2022 2/3 information that his sister was in serious condition. He rushed there and saw his sister in unconscious condition. She was killed by administering poisonous substances.

The learned counsel for the petitioner has submitted that petitioners are old age father-in-law and mother-in-law of the deceased. They have no concern with day-to-day affairs of the couple. He has submitted further that the husband of the deceased, Ganesh Ravidas was put on trial and was acquitted by the Additional Sessions Judge 3rd Jamui in Sessions Trial No. 143 of 2022 vide Judgment and order dated 02.08.2022, as none of the witnesses came forward to support the prosecution case. The petitioners are the persons of clean antecedent. The petitioners are in the custody since 07.06.2022.

Considering the above-mentioned facts and circumstances, let the petitioners above-named be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 448 of 2021, subject to the following conditions:- (i) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.

(ii) If the petitioners are found involved in future in

Patna High Court CR. MISC. No.49560 of 2022(2) dt.16-12-2022 3/3 the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioners and the learned court below will take decision in accordance with law.

Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
