JUSTICE SUDHIR SINGH ORAL ORDER 06-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 341, 323, 324 and 307 of the Indian Penal Code. Allegation against the petitioner is that he gave knife blow to both brothers of the informant.

It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 23.3.2015. Chargesheet has been submitted in this case. There is no allegation of tampering with the evidence. From perusal of the injury report and the case diary it appears that injuries no. 1, 2, 3 and 4 are simple in nature and opinion with regard to injury no. 5 has been reserved. The present case has been instituted after ten days of the occurrence for which no explanation has been made on behalf of the prosecution.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

No.33843 of 2015 (3) dt.06-10-2015 2 / 2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Saran at Chapra, in connection with Ekma P.S. Case no. 25 of 2015.
