====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER --------------- 30-10-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Sabour (Gouradih) P.S. Case No.41 of 2015 registered under Sections 304(B)/34 of the Indian Penal Code.

The accusation is that the daughter of the informant was set on fire by her husband and in-laws on 02.03.2015 due to non fulfillment of the dowry demand, who died in course of treatment on 14.03.2015, after 12 days of the occurrence. Learned counsel appearing on behalf of the petitioner submits that the petitioner is the father-in-law of the deceased. In fact, the deceased sustained burn injury in course of cooking meal

Patna High Court Cr.Misc. No.48087 of 2015 (2) dt.30-10-2015 2/2 and she was rushed by her husband and in-laws to the Mayaganj Hospital, Bhagalpur, from where she was taken to Bokaro, where she died after 12 days of the occurrence. Moreover, the information regarding sustaining burn injury by the deceased was given to the informant, who had come at the hospital alongwith her two other children. The petitioner is in custody since 08.05.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, First Class, Bhagalpur, Sri Md. Shalim, in connection with Sabour (Gouradih) P.S. Case No.41 of 2015.
