The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 307, 341, 323, 504, 448, 379/34 of the Indian Penal Code. The prosecution case is that the informant was sitting at the place of construction work of the Tomb of Dasharath Manjhi when the petitioners came and took away three pieces of stones of red colour and on protest being made by informant the petitioners assaulted him with lathi. Thereafter Gulabiya Devi and her sister Sibi Devi came to rescue then they were also assaulted. It is further alleged that these petitioners entered into the house of the informant and snatched Rs. 2500/-.

No.1380 of 2016 (2) dt.12-01-2016 2/2 It is submitted by learned counsel for the petitioners that the petitioners are the staff of the contractor who has been awarded the contract for construction of Dashrath Manjhi Tomb, hence there is no question of the petitioners taking away the stones and maliciously the case has been lodged. The injuries have been found to be simple in nature. The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioner if they surrender within a period of six weeks in connection with Atri P.S. Case No. 103 of 2015 pending in the Court of A.C.J.M., IInd, Gaya. Accordingly, the application is disposed of.
