2. The petitioner is apprehending his arrest in connection with Bajpatti P.S. Case No. 166 of 2023, F.I.R. dated 03.06.2023 for the offences punishable under Sections 394 and 34 of the Indian Penal Code.
3. According to prosecution case, three miscreants entered into the house of the informant and assaulted him and his wife and son and looted his articles.
4. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. He further submits that in fact, petitioner is not named in the F.I.R and his name has been transpired on the basis of the confessional statement of the apprehended co-accused,
Patna High Court CR. MISC. No.48269 of 2025(2) dt.06-08-2025 2/2 namely, Hasan Manuri and except the aforesaid, no other material has come during investigation to suggest the involvement of the petitioner in the present occurrence.
5. Learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits that it has come during investigation that the looted articles have been recovered from the house of the petitioner and apart from that the petitioner carries one criminal antecedent other than the present one.
6. Considering the aforesaid facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Bajpatti P.S. Case No. 166 of 2023 pending in the court of Judicial Magistrate, Pupri at Sitamarhi.
7. Prayer is refused.
