The petitioner seeks pre-arrest bail in connection with Manpur P.S. Case No. 44 of 2015 registered under Sections 420, 406 and 409 of the Indian Penal Code.

It is contended that it would be apparent from the Annexures appended to the FIR itself that the majority of work for which amount was withdrawn has already been executed. The allegation regarding sub-standard quality of work is attributable to the Junior Engineer and Technical Supervisor and not to the petitioner. It is further contended that the petitioner was the headmaster of the school and he has already retired on attaining the age of superannuation in 2012. It is also contended that the

Learned counsel for the State has opposed the prayer for pre-arrest bail.

Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioner Yogendra Sah is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Manpur P.S. Case No. 44 of 2015, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Pradeep/- U T
