Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Bhagwanpur P.S. Case No. 138 of 2022 registered for the offences punishable under Sections 366A and 363 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is in custody since 21.06.2022 and there is no criminal antecedent against the petitioner. The victim-girl has given the statement under Section 164 of the Cr.P.C. that she was not kidnapped but had gone herself to Chennai when scolded by her

It is further submitted that the victim age is assessed in the medical report, between the age of 18-20 years and both the parties have amicably compromised in the matter. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case as well as period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Bhagwanpur P.S. Case No. 138 of 2022.
