This is an application for grant of anticipatory bail in connection with Jamui P.S.Case No.88 of 2019 registered for the offences punishable under Sections 363 and 366(A) of the Indian Penal Code.

The allegation is regarding the accused persons having kidnapped the victim girl.

Learned counsel for the petitioner has submitted that the petitioner is the mother of the main co-accused person, namely, Nakul Tanti, who is said to have kidnapped the victim girl. It is further submitted that the husband of the petitioner has already been granted regular bail by a coordinate

Patna High Court CR. MISC. No.50977 of 2019(4) dt.26-11-2019 2/2 Bench of this Court vide order dated 11.09.2019 passed in Cr.Misc.No.38018 of 2019. Lastly, it is submitted that the petitioner is not having any complicity in the matter and, in fact, the victim girl has also been recovered. The petitioner is stated to be having a clean antecedent.

Learned counsel for the informant has vehemently opposed the prayer for anticipatory bail.

Considering the nature of accusation, I deem it fit and appropriate to admit the petitioner to the privilege of anticipatory bail. Accordingly, the above named petitioner, in the event of her arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Jamui in connection with Jamui P.S.Case No.88 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
