The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 354(B), 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

It is a case of assaulting and opening the fire by coaccused Mukesh Rai by his revolver to the informant, namely, Amit Kumar.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that specific allegation of opening the fire is against co-accused Mukesh Rai and not this petitioner. There is general and omnibus allegation against him and no allegation of

Patna High Court CR. MISC. No.60083 of 2021(2) dt.11-07-2022 2/2 outraging the modesty of the mother of the informant. Petitioner has got clean antecedent.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Mahua P.S. Case No. 679 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
