2. The petitioner, who is in jail since 03.04.2024 seeks regular bail in connection with Rail/Kiul P.S. Case No. 217 of 2023 registered for the offence under Sections 328, 379 of the Indian Penal Code.

3. As per the prosecution case, the informant was administered some poisonous substance / sedative and he lost his senses.

4. After gaining his senses, the informant has given statement that co-passenger had offered him jhalmurhi and after taking the same, he had lost his senses. All the belongings of the informant i.e. two bags, mobile phone, ATM Card and Rs. 1150/- were taken away by the co-passenger who subsequently

Patna High Court CR. MISC. No.53898 of 2024(2) dt.21-08-2024 2/2 have been found to be a member of Jaharkhurani Gang.

5. Co-accused Kundan Singh was found in possession of the mobile phone of the victim-informant. He has given the statement that it is the petitioner who had given him the mobile phone.

6. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. Accordingly, this application for regular bail is rejected.
