02. In the present case, the petitioner seeks bail in connection with Punpun P.S. Case No. 103 of 2025 registered for the alleged offences under Sections 115(2), 126(2), 109(1), 351(2), 352, 3(5) of Bharatiya Nyaya Sanhita, 2023.
03. As per prosecution case, petitioner hit the informant with iron rod on his head causing injury to him. The petitioner also struck the elder brother of the informant with a bamboo. The occurrence took place in the background of dispute over drainage of sewer water.
04. Learned senior counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been
Patna High Court CR. MISC. No.49394 of 2025(4) dt.12-11-2025 2/3 falsely implicated in this case. The petitioner is own brother of the informant and some dispute arose over Nal-Jal Scheme. The informant himself assaulted the petitioner causing fracture of his head and also assaulted his wife. There is case and counter case between the petitioner as the petitioner has lodged Punpun P.S. Case No. 104 of 2025 against the informant and his family members. The petitioner is having clean antecedent. The petitioner is in custody since 02.05.2025 and charge-sheet has been submitted.
05. Learned APP for the State opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the relationship of the parties and also considering the period of custody of the petitioner and his clean antecedent along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Masaurhi, Patna in connection with Punpun (Kewda OP) P.S. Case No. 103 of 2025, subject to the conditions mentioned in Section 480(3) of BNSS and the following
Patna High Court CR. MISC. No.49394 of 2025(4) dt.12-11-2025 3/3 conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
