Petitioner seeks bail in Mokama P.S. Case No.226 of 2018 instituted for the offence under Section(s) 326, 307/34 Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that there is specific allegation against Shivam Kumar in the written report of causing firearm injury to son of the informant. It is mentioned in the written report that this petitioner also fired, but it did not hit anybody.

Petitioner is in custody since 13.05.2019 having clean antecedents.

In the facts and circumstances of the case, prayer of

Patna High Court CR. MISC. No.45986 of 2019(2) dt.30-07-2019 2/2 the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st class, Barh, in connection with Mokama P.S. Case No.226 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
