JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 08-08-2022 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. Learned counsel for the petitioner undertakes to remove the defects within four weeks of resumption of normal court proceedings. In the eventuality of non-removal of defects within stipulated period, office will place the matter before the Bench. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 342, 308, 498A of the Indian Penal Code and section 3⁄4 of Dowry Prohibition Act. Vide order dated 07.12.2021, matter was referred to the Mediation Centre.
I perused the Mediation Report kept at Flag 'M1' dated 26.07.2021, whereby it is stated that the dispute between the
Patna High Court CR. MISC. No.4483 of 2021(7) dt.08-08-2022 2/2 parties has been resolved through the process of mediation. The terms of settlement mutually agreed upon by them is also enclosed with the report.
It is submitted by learned counsel for the petitioner that petitioner is agreeable to comply the terms of the agreement dated 18.07.2022.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Sonepur P.S. Case No.325/2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
However, if the necessary terms and conditions of the agreement is not complied by the petitioner by August, 2022, the O.P. No.2 is at liberty to file for cancellation of bail of the petitioner before the learned court below.
