The petitioner seeks bail in connection with Agiaon (G) P.S. Case No.52 of 2015 registered under Sections 399 and 402 of the Indian Penal Code besides Sections 25(1-B)A/26/35 of the Arms Act.

The accusation is that when the petitioner alongwith 5-6 other criminals had assemble to make crime near Damania Bridge situated on road going from Garhani to Agiaon, the informant, who is A.S.I. alongwith other police personnel on receiving secret information rushed to the place of occurrence from where the petitioner and four others were apprehended. On search, one

Learned counsel appearing on behalf of the petitioner submits that the petitioner has falsely been implicated in this case on mere suspicion showing the aforesaid recovery from his possession. While the petitioner has been made accused in one more case, as detailed in paragraph-3 of the application, but in that case he is on bail. In the present case, the petitioner is in custody since 13.06.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Divya Jaiswal, Judicial Magistrate, First Class, Ara, in connection with Agiaon (G) P.S. Case No.52 of 2015. (Rajendra Kumar Mishra, J) P.S./- U T
