Petitioner is languishing in judicial custody since 17.10.2017 in connection with Jokihat P.S. Case No.297 of 2017 for offences punishable under Sections 328, 302, 120B of the Indian Penal Code.

The prosecution case, as lodged by the informant, is that his daughter was married to the petitioner's son Md. Ahmad but all the family members including the husband used to torture her for non-fulfillment of demand of dowry. She had four children and has been killed by poisoning her.

No.11575 of 2018 (3) dt.30-03-2018 2/2 It has been submitted by the learned counsel for the petitioner that he is father-in-law of the deceased and has separate home and hearth from the deceased and her husband. He submits that husband is already in custody and he being an old man of 75 years has been punished enough. He submits that charge-sheet has already been submitted and there is no allegation of tampering of the prosecution witnesses by the petitioner.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record and that the husband is already in custody, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 297 of 2017.
