Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 3.8.2017 passed in Cr. Misc. No.34789 of 2017 with a direction that the petitioner may renew his prayer for bail after framing of charge in this case. Submission of the learned counsel for the petitioner is that the charge has been framed in this case and there is absolutely no overtact mentioned against the petitioner and he is in custody since 5.5.2017.

Heard learned A.P.P. and the learned counsel for the informant. They have opposed the prayer for bail stating that the petitioner is accused in 16 other cases.

Having heard both sides and in view of the facts and

No.5223 of 2018 (2) dt.08-02-2018 2/2 circumstances as well as the fact that there is no specific allegation of firing against the petitioner, as such, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Buxar in connection with Buxar (T) P.S.Case No.149 of corresponding to Sessions Trial No.208 of 2017 with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below and further the petitioner will appear before the local police station of his area in the first week of each month for a period of one year so that the police may watch is conduct or till the conclusion of the trial, whichever is earlier; otherwise his bail bond shall be cancelled. With the aforesaid observation, this application is allowed.
