The petitioners seek bail in a case instituted for the offences under Sections 399, 402, 413, 414, 307, 420, 467, 468, 120(B) of I.P.C. and Sections 25(1-b)a, 26, 27, 35 of Arms Act and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Prosecution case, in short, is that 93 ml liquor and one country made pistol and three cartridges are recovered. It has been submitted on behalf of the petitioners that the petitioners are in custody since 1.6.2019 and have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. No arms is alleged to

Patna High Court CR. MISC. No.46250 of 2019(2) dt.30-07-2019 2/2 have been recovered from possession of the petitioners. It is alleged that 93 ml liquor is recovered. There is no compliance of Section 100 Cr.P.C.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R./complaint case.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Brahampura P.S. case No.146 of 2019.
