The petitioner has prayed for bail in a case registered for the offence punishable under sections 304B/34 of the Indian Penal Code.

As per allegation in the FIR, petitioner along with his family members has tortured in various ways to the daughter of the informant due to non-fulfillment of dowry demand and ultimately she was being killed.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is father-in-law of the deceased and has been falsely implicated in this case. He has never demanded any thing from the deceased. The sole responsibility to take care of wife is upon husband and not against his family

Patna High Court CR. MISC. No.50422 of 2023(2) dt.11-08-2023 2/2 members. He is living separately and no concern with mess and business of the deceased and her husband. Similarly situated other accused person has already been enlarged on bail by another coordinate Bench of this Court vide order dated 24.12.2022 passed in Cr. Misc. No. 69116 of 2022. Petitioner is a very old man of 60 years and languishing in judicial custody since 27.01.2023.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJM IX Vaishali at Hazipur in Desari (Sahdei O.P.) P.S. Case No. 273 of 2022.
