In this application for anticipatory bail the petitioner apprehends his arrest in a case punishable for the offence under sections 420, 471 and 406/34 of the I.P.C.
Allegedly the petitioner and other accused persons allured the informant resulting the informant invested the amount of Rs. 60,00,000/- and thereafter amount of Rs. 3,30,000/- was returned by way of first installment and again amount of Rs. 1,50,000/- was returned and thereafter all including the petitioner vanished from the office and they were not found available any where which caused and compelled him to ultimately file this case.
Submission is of false implication. From the F.I.R. the
Patna High Court Cr.Misc. No.30499 of 2014 (2) dt.21-01-2015 2/2 petitioner was not found involved in alluring the informant to invest money in any firm and as such he deserves sympathetic consideration, to which the learned A.P.P. opposes. Considering that the petitioner has actively been participating in alluring the informant to invest the amount and after investment of the amount the petitioner alongwith other accused persons vanished from the office causing the informant in heavy loss and as such this Court is not inclined to grant pre-arrest bail to the petitioner and accordingly such prayer of the petitioner stands rejected in connection with Kotwali (Barari) P.S. Case No. 265 of 2014 pending in the Court of C.J.M. Bhagalpur. (Jitendra Mohan Sharma, J) Abhay/- U T
