The petitioner has filed the instant application for grant of regular bail in connection with Maigra P.S. Case no.16 of 2019 registered against three unknown under section 392 of the Indian Penal Code.

As per the allegation in the F.I.R., it is stated that three persons on the point of pistol looted a sum of Rs.1,97,490/-. It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown. Inspite of the petitioner being in custody since 5.8.2020 he has not been put on T.I. parade. Referring to the order of the learned court below, it is submitted that some of the so called witnesses who have

Patna High Court CR. MISC. No.5361 of 2021(3) dt.27-07-2021 2/2 identified the petitioner have not disclosed their identity. The reason for false implication of the petitioner is his antecedent. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner having remained in custody for more than 11 months, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Maigra P.S. Case no.16 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Sherghati, Gaya.
