JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-02-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 386 and 34 of the Indian Penal Code.
Prosecution case is that co-accused Goga Paswan along with his associates variously armed attacked at the house of the informant, demanded ransom and took away earning of the informant. The F.I.R. was lodged against Goga Paswan and subsequently, Goga Paswan named this petitioner. It is submitted by learned counsel for the petitioner that Goga Paswan robbed a Bolero vehicle from one Nitish Kumar leading to registration of Ashathawan P.S. case No.108 of 2014 wherein petitioner is a witness against Goga Paswan. Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Fatuha P.S. Case No.261 of 2014, pending in the court of learned A.C.J.M., Patna City, District- Patna. With the above observation, this application is disposed of.
