====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 10-11-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 363 and 366 of the Indian Penal Code.

The informant alleges that the accused persons including the petitioners kidnapped his minor daughter aged about 17 years on 06.08.2021, but later the victim was handed over to the Mukhiya, further, again on 04.09.2021, the victim was kidnapped by the accused persons including the petitioners and is traceless.

Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioner no. 1 is a woman and have been falsely implicated in the present case, it is

No.49671 of 2022(2) dt.10-11-2022 2/2 next submitted that the victim has returned and her statement was recorded under Section 164 Cr.P.C. wherein she has disclosed her age as 18 and a half years and has not supported the prosecution case rather has stated that she has married Veer Paswan, it is further submitted that petitioner no. 1 being mother of Veer Paswan and petitioner no. 2 being brother of Veer Paswan have been falsely implicated.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Mansi P.S. Case No. 253 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
