The petitioner seeks pre-arrest bail in connection with Turkauliya (Banjariya) P.S. Case No. 259 of 2015 registered under Sections 363, 365, 366-A and 504 of the Indian Penal Code. Regard being had to the nature of allegation as also the statement of the victim recorded under Section 161(3) of the Code of Criminal Procedure in paragraph 15 of the case diary wherein she has made specific allegation that she was subjected to repeated rape by the petitioner, I am not inclined to grant him prearrest bail.
