The two petitioners herein are brothers and filed the application seeking anticipatory bail in connection with Bhojpur (Barahara) P.S. Case No. 74 of 2014 instituted under Sections 341, 323, 308 and 379 of the Indian Penal Code.
The contention of the petitioner is that there is allegation of general nature against all the accused persons. As against petitioner no. 2, the allegation is that he assaulted with lathi on the hand of the informant. It further appears that there is no allegation of assault attributed to petitioner no. 1. Considering the aforesaid fact as also the fact that the petitioner no. 1 does not carry any criminal antecedent, in the
Patna High Court Cr.Misc. No.30333 of 2014 (2) dt.14-01-2015 event of his arrest or surrender within four weeks in the Court below, petitioner no. 1 namely Kunal Singh shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Bhojpur (Barahara) P.S. Case No. 74 of 2014 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure .
The prayer for anticipatory bail on behalf of petitioner no. 2 stands rejected. He will surrender and pray for regular bail. (Kishore Kumar Mandal, J) Pankaj/- U
